Terms of Service

Welcome to SongSmile. These Terms of Service govern your use of SongSmile, including our website, app, artist pages, QR code tools, tipping features, fan follows, email signups, media features, show updates, and Live Now alerts.
By using SongSmile, you agree to these Terms.
1. SongSmile Is a Beta Product
SongSmile is currently in beta. The service may change, break, be interrupted, be removed, or be updated at any time. We may add, remove, limit, or modify features as we test and improve the product.
You understand that beta products may contain bugs, incomplete features, or unexpected behavior.
2. Who Can Use SongSmile
You must be at least 13 years old to use SongSmile. If you are under 18, you may use SongSmile only with permission from a parent or legal guardian.
If you create an artist account, accept tips, connect a payment account, or receive payouts, you must be legally allowed to do so and must provide accurate information to SongSmile and our payment providers.
3. Accounts
You are responsible for your account and for keeping your login information secure. You agree to provide accurate information and to update it when needed.
You may not impersonate another person, artist, business, venue, or organization.
We may suspend or remove accounts that violate these Terms, create risk, abuse the service, or interfere with other users.
4. Artist Accounts
Artist accounts may create public artist pages, add links, upload media, display QR codes, receive tips, collect follows, receive fan email signups, post show information, and use Live Now features where available.
Artists are responsible for the content they publish, the accuracy of their profile, and any communications they send to fans.
5. Fan Accounts
Fan accounts may follow artists, tip artists, join artist updates, view artist pages, submit media where enabled, and interact with SongSmile features.
Fans are responsible for the information, messages, payments, and media they submit.
6. Tips and Payments
SongSmile may allow fans to tip artists or make payments through third-party payment providers such as Stripe.
Payment processing is handled by third-party providers and may be subject to their own terms, fees, verification requirements, and restrictions.
Unless clearly stated otherwise, tips are voluntary and may be non-refundable once processed. Artists are responsible for any taxes, reporting, or obligations related to money they receive.
SongSmile may show payment status, tip amounts, and related transaction details inside the app. We do not guarantee that any artist will receive a specific amount of tips or income.
7. Fees
SongSmile may choose to charge, waive, or change platform fees in the future. Payment processors may charge standard processing fees.
Any applicable fees should be reviewed before completing a transaction.
8. Content and Media
You are responsible for all content you upload, submit, post, or share through SongSmile, including text, photos, videos, links, show details, messages, and profile information.
You may not upload or share content that:
- You do not have the right to use
- Infringes someone else's copyright, trademark, privacy, publicity, or other rights
- Is abusive, harassing, hateful, threatening, sexually exploitative, or illegal
- Contains malware, scams, spam, or deceptive activity
- Impersonates another person, artist, business, or organization
By uploading or submitting content, you give SongSmile permission to host, display, process, resize, transmit, and use that content as needed to operate and promote the service.
You keep ownership of your content, but you are responsible for having the rights needed to share it.
9. Fan-Submitted Media
Artists may allow fans to submit media. Fan-submitted media may require artist review before appearing publicly.
SongSmile may remove media or restrict uploads if content appears abusive, illegal, infringing, spammy, unsafe, or otherwise inappropriate.
10. Live Now Alerts and Show Updates
SongSmile may provide Live Now alerts, show announcements, and artist updates. We do not guarantee that alerts will always be delivered, received, accurate, or available in real time.
Artists are responsible for the accuracy of their show details, live status, and announcements.
11. Email Signups and Fan Lists
Fans may choose to share their email address or other information with an artist. Artists are responsible for using fan information responsibly and complying with applicable email, privacy, and marketing rules.
Artists may not use fan information for spam, harassment, unauthorized resale, or unrelated third-party marketing.
12. Prohibited Use
You agree not to:
- Abuse, harass, threaten, or harm other users
- Upload illegal, infringing, or harmful content
- Use SongSmile for fraud, scams, spam, or deceptive activity
- Interfere with the security or operation of SongSmile
- Attempt to access accounts, data, or systems without permission
- Circumvent payment, verification, storage, moderation, or access controls
- Use SongSmile in a way that violates applicable law
13. Third-Party Services
SongSmile may link to or integrate with third-party services, including payment providers, social platforms, music platforms, email services, hosting providers, and analytics tools.
We are not responsible for third-party services, content, policies, fees, outages, or actions.
14. No Guarantee of Results
SongSmile helps artists connect with fans, but we do not guarantee tips, follows, email signups, bookings, revenue, exposure, or career results.
15. Service Changes and Availability
We may modify, suspend, limit, or discontinue any part of SongSmile at any time. We may also update, remove, or restrict features during beta testing.
We are not responsible for downtime, bugs, data loss, missed alerts, failed uploads, failed payments, or other issues to the maximum extent permitted by law.
16. Termination
You may stop using SongSmile at any time.
We may suspend or terminate your access if you violate these Terms, create risk, abuse the service, or use SongSmile in a way that may harm users, artists, payment providers, or the platform.
17. Disclaimer
SongSmile is provided "as is" and "as available." We disclaim warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.
18. Limitation of Liability
To the maximum extent permitted by law, SongSmile will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost opportunities, or business interruption.
19. Indemnity
You agree to defend, indemnify, and hold SongSmile harmless from claims, damages, losses, liabilities, costs, and expenses arising from your use of the service, your content, your violation of these Terms, or your violation of someone else's rights.
20. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date.
Your continued use of SongSmile after changes are posted means you accept the updated Terms.
